Trucking: Mexican truck plan continues

The Federal Motor Carrier Safety Administration (FMCSA) has announced that it will move ahead with the controversial Mexican cross-border truck plan even though many Members of Congress successfully cut funding for the program.

Congress had added language to the recent omnibus spending bill that stated that none of the funds appropriated could be used “to establish a cross-border motor carrier demonstration project.” President Bush signed the omnibus bill into law on December 26.

According to their interpretation, FMCSA has said that the language approved by Congress in the omnibus bill would not affect the current crossborder program but rather only affect future proposals for cross-border truck movement. President Bush said at the time he signed the omnibus bill, “This legislation contains certain
provisions similar to those found in prior appropriations bills passed by the Congress that might be construed to be inconsistent with my Constitutional responsibilities. To avoid suchpotential infirmities, the executive branch will interpret and construe such provisions in the same manner as I have previously stated in regard to similar provisions.”

FMCSA announced that they have notified another 37 Mexican-based motor carriers that they have passed a Pre-Authorization Safety Audit and those companies will now be allowed to operate in the U.S.
